1. Nature of Service

Timeshare Warehouse operates as a resale listing platform that connects prospective buyers with timeshare owners looking to sell or transfer their vacation ownership interests. Our role is that of an intermediary — we facilitate introductions and assist with the transfer process, but we are not a party to any purchase or sale transaction between buyer and seller.

• We do not own, manage, or operate any resorts, hotels, or vacation properties.
• We do not guarantee the availability, condition, or quality of any listed property.
• Listing details are provided by sellers and third-party sources; while we strive for accuracy, we cannot verify every detail.

2. No Guarantee of Availability

All timeshare listings displayed on this website are subject to availability and may be removed or updated at any time without notice. The presence of a listing does not guarantee that the property is currently available for purchase or transfer. Prices, fees, and terms shown are subject to change.

3. Inquiries Are Not Purchases

Submitting an inquiry, contact form, or request for information through this website does not constitute a purchase, reservation, or binding agreement of any kind. An inquiry is simply a request for more information. No transaction is finalized until all parties have executed the appropriate legal documents and completed the closing process.

4. TES as Intermediary

Timeshare Equity Services acts as a settlement and transfer services provider. Our services include:

• Facilitating communication between buyers and sellers
• Coordinating title transfer documentation and closing services
• Providing guidance through the timeshare transfer process

TES does not provide legal advice, financial advice, or property appraisals. We recommend that you consult qualified professionals before entering into any real estate transaction.

5. Listing Accuracy & Disclaimers

While we make reasonable efforts to ensure listing information is accurate and current:

• Maintenance fees, property taxes, and resort amenities are determined by the resort and may change without notice.
• Photographs and descriptions may not reflect the current condition of a property or unit.
• Exchange company affiliations (e.g., RCI, Interval International) are subject to the policies of those organizations.
• Availability of specific weeks, units, or points is not guaranteed until confirmed in writing.

6. Right of First Refusal

Many timeshare resorts maintain a Right of First Refusal (ROFR), which allows them to match any purchase offer and buy back the timeshare themselves. Transactions facilitated through this site may be subject to ROFR by the applicable resort or developer. TES is not liable if a resort exercises its ROFR and the transaction cannot be completed.

7. Fees & Closing Costs

Any applicable fees, closing costs, or transfer charges will be disclosed before you enter into a binding agreement. You are responsible for understanding all costs associated with your transaction, including but not limited to:

• Transfer and closing fees
• Recording fees and government charges
• Outstanding maintenance fees or assessments
• Resort transfer fees

8. User Conduct

By using this website, you agree not to:

• Provide false, misleading, or fraudulent information
• Use the site for any unlawful purpose
• Attempt to interfere with the operation or security of the site
• Scrape, harvest, or collect data from the site without written permission

9. Intellectual Property

10. Limitation of Liability

Our total liability for any claim shall not exceed the amount of fees you have paid to TES in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Timeshare Equity Services, Inc. from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of this website or your violation of these Terms.

12. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Quebec.

13. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time. Changes take effect when posted on this page. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
